Copyright & DMCA

In short: we respect copyright and expect our users to. If material on DBX Sign infringes your copyright, tell our designated agent below and we will act. If your material was removed in error, you can say so and get it back.

Before you send a notice

Please consider whether the use is permitted — by licence, by agreement, or as fair use. If you knowingly misrepresent that material is infringing you may be liable for damages, including costs and legal fees, under 17 U.S.C. §512(f). We may send a copy of your notice, including the contact details in it, to the person who uploaded the material.

What a notice must contain

  1. Identification of the copyrighted work you say has been infringed.
  2. Identification of the material you say is infringing, described well enough for us to find it — a URL, an envelope identifier, or an equally specific description.
  3. Your name, mailing address, telephone number and email address.
  4. A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on their behalf.
  6. Your physical or electronic signature.

What we can and cannot reach

We will remove or disable access to material on our own site expeditiously on receiving a compliant notice. A document inside a sent envelope is a different matter. Once an envelope has been sealed, its contents and their fingerprints are fixed — that immutability is the evidence the service exists to produce, and we will not quietly alter a sealed record. We will disable access to it and notify the sender, and we will tell you we have done so. If your complaint is about the content of a document somebody sent, the sender is the person who put it there and you should contact them as well.

Counter-notification

If your material was removed and you believe that was a mistake or a misidentification, send our agent a counter-notice containing: your signature; identification of the material and where it was before removal; a statement under penalty of perjury that you have a good faith belief it was removed as a result of mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the federal district court for your district, or for the District of Arizona if you are outside the United States, and that you will accept service from the person who complained.

We will forward it to the complainant. If they do not file a court action within 10 to 14 business days, we will restore the material.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe. So that this is predictable rather than arbitrary:

Nothing here limits any other right or remedy available to us or to a rights holder.
